With the introduction of new legislation surrounding online gambling in the United States, online poker sites are becoming increasingly popular. Below the legal situation surrounding the matter is discussed, and sites where residents in the states where online poker gambling is legal, are listed below.

US LAWS SURROUNDING ONLINE GAMBLING

Until 2012 online poker was considered to be illegal due to the Wire Act and the Illegal Gambling Business Act. This understanding changed when a New York federal judge dismissed a case against a man charged with conspiring to run an underground poker club. The federal judge decided that poker was a game of skill, not chance, and the current laws did not cover skill-based games. With this decision, Nevada, Delaware, and New Jersey began to allow state residents to play online poker. Nevada stipulated players had to be physically located in the state, and be aged 18, while Delaware requires the same – players had to be residents of the state. New Jersey, on the other hand, offered online gambling to not just residents, but also visitors. Further, eventually, all three states joined together under a poker agreement to allow residents in all states to play online poker in another state’s games. As of September 2020, only Pennsylvania, West Virginia, and Michigan are the states to have also legalized online poker games. Other states are believed to be headed towards introducing legislation to legalize online poker.
